General terms and conditions of purchase

All purchases made on our website (hereinafter www.equinecode.com) by the customer (hereinafter "the Customer") shall be subject to the General Terms and Conditions of Purchase set out in this document.

If any aspect of the purchase is not contemplated in the same, it will be regulated according to the legislation in force in Spain.

The order placed by the Client implies agreement and acceptance of these General Conditions of Purchase. No stipulation made by the Client on these Terms and Conditions of Purchase may differ from those established by Sanbiotec Consulting, S.L.. All the information contained in the web pages of www.equinecode.com concerning the articles, their characteristics, their prices, their conditions of purchase including their forms and conditions of collection and payment may be modified by Sanbiotec Consulting, S.L. at any time and without prior notice, with the aim of keeping the general public informed in a timely manner of
such changes.

Some aspects of the present General Conditions of Purchase may be varied by special agreement between the Client and Sanbiotec Consulting, S.L. with the express consent of Sanbiotec Consulting, S.L..

1. PRODUCTS AND PRICES
1.1 Unless there is a typographical error or omission, the characteristics and prices of the services offered for sale are clearly shown on the various web pages that make up the www.equinecode.com website.

1.2 The amount of the prices of the services as well as any of their characteristics may be subject to revision by Sanbiotec Consulting, S.L. at any time without any obligation to notify such changes to the Client by any means other than the exposure of such changes on its web pages. On the other hand, except for correction of typographical errors, once the purchase of a service has been made, Sanbiotec Consulting, S.L. will undertake to maintain the price in force at the time the order was placed.

1.3 TAXES:

1.3.1 The prices that Sanbiotec Consulting, S.L. shows on its website do NOT include taxes. The VAT (Value Added Tax), will be applicable only to customers whose current residence is located within the areas of specific application for this tax and when the customer's situation so requires, respecting in any case, the Spanish and European laws relating to it.

1.3.2 In addition to the taxes levied on the sale, the customs systems of each country will apply the corresponding tax charges.

1.3.3 Due to their special tax regime, the geographical areas corresponding to the Canary Islands, Ceuta and Melilla are considered non-EU territories, and therefore purchases made by residents of these territories are exempt from VAT (customs clearance costs and import taxes are not included in the price of the item or shipping costs).

2. ORDERS
2.1 It shall be understood that the Client has read, understands and freely accepts these General Purchasing Conditions when he/she places his/her order through the purchase forms on the website www.equinecode.com by accepting (ticking) the box provided for this purpose.

2.2 Given that there are links on the website www.equinecode.com for free viewing of these General Conditions of Purchase, these also apply to products ordered by any means other than the Internet order form (by e-mail, telephone, instant messaging or in person).

2.3 Sanbiotec Consulting, S.L. reserves the right at all times to accept or refuse at its own discretion any request to purchase, extend, renew, modify or change any of the services displayed on its web pages.

2.4 The Client affirms that the personal, payment and shipping data provided to Sanbiotec Consulting, S.L. are real and reliable. In the event that Sanbiotec Consulting, S.L. found that any or all of these data are false, the purchase will be automatically canceled and the customer can not claim any refund regarding the costs incurred by the management.

2.5 In the event that the Client provides data of a third person or entity when making the purchase, the Client shall be solely responsible for such third person or entity to know and expressly accepts such situation. All liability for damages that may arise from this fact shall be borne entirely by the Client, excluding Sanbiotec Consulting, S.L. from any liability.

2.6 Any indication or query made by the customer in the sections for comments on the order or in subsequent communications will be taken as merely informative and will in no way condition the purchase made (the service requested, the method of payment, delivery times, delivery and, by extension, any of these Conditions of Purchase).

2.7 Sanbiotec Consulting, S.L. also reserves the right to withhold an order pending any information needed from the customer. In such a case the delivery times will be delayed in relation to the time taken by the customer to reply.

3. PAYMENTS
3.1 The Customer is responsible for the payment of invoices even if a third party intervenes on behalf of the Customer, whereby the responsibility for providing authentication, access or identification data to a third party is solely and exclusively that of the Customer.

3.2 Sanbiotec Consulting, S.L. will issue the corresponding invoice for the services purchased and will be sent to the Client by e-mail so that subsequently and if desired, you can print it on paper to have it physically.

3.3 In the event of a chargeback of a credit card/paypal charge, the cause of which is not due to an error directly attributable to Sanbiotec Consulting, S.L., the Client will be charged with an additional fee of 5% on the value of the amount returned, which will make up the costs incurred both in bank fees and collection management. Said amount will be charged to the Client in the terms and forms that Sanbiotec Consulting, S.L. deems appropriate.

3.4 In any case Sanbiotec Consulting, S.L. always reserves the right to decline an order or modify its form or type of payment as it deems appropriate.

3.5 FORMS OF PAYMENT:
Payment will always be made in EUROS and free of any bank charges or other transaction fees.

3.5.1 Deposits or bank transfers made from Spain.

3.5.1.1 The Customer must make the transfer or deposit of the corresponding credit to the Bank Account number provided when placing the order.

3.5.1.2 At the time of payment, it is important that you indicate in the concept or subject of the bank document the order number assigned to you. You must make the deposit or transfer within 48 hours of the order, otherwise your reservation will expire.

3.5.1.3 For the payment verification process, you must send us the bank proof of payment by e-mail to info@equinecode.com or by WhatsApp +34 673000981. In any case, the order will not be considered effective until our management department has the bank confirmation of payment, then the order will be processed.

3.5.1.4 The payment of the purchase amount must be received by Sanbiotec Consulting, S.L. free of bank charges or other expenses derived from the transaction.

3.5.2 Transfers made from outside Spain.

3.5.2.1 In addition to the provisions of the previous paragraph, you must take into account that you must pay for your purchases in EUROS and that any bank charges for currency exchange will be borne by the customer.

3.5.2.2 When ordering your international transfer, the Client must always indicate to your bank that it will be he who will be responsible for bank charges and expenses arising from the transaction. Otherwise, Sanbiotec Consulting, S.L. could stop the shipment of your order by not receiving the full amount thereof.

3.5.3 Stripe payments

3.5.3.1 This is a form of card payment on the Internet. In this type of online payment, the customer enters his card details at the time of purchase.

3.5.3.2 It is a secure method of payment. It will be made in a direct, legitimate and secure manner while maintaining the privacy of the card information at all times.

3.5.3.3 Credit card fraud is a criminal offence, and Sanbiotec Consulting, S.L., will take legal action against anyone who carries out or attempts to carry out a fraudulent transaction or scam.

3.6.4 Payment via PAY-PAL

3.6.4.1 The customer can select this payment method to pay for purchases. In doing so, he/she will be connected to the Paypal environment so that he/she can identify him/herself as a user and complete the payment. Likewise, if the customer does not have a Paypal account, the customer may use the payment gateway of this company to make the payment by credit card.

3.6.4.2 Credit card fraud is a criminal offence, and Sanbiotec Consulting, S.L., will take legal action against anyone who carries out or attempts to carry out a fraudulent transaction or scam.

4. SHIPMENTS AND DELIVERY TIMES
4.1 The place of destination to receive the Kit chosen by the Customer will determine the period of time that elapses from the time we receive confirmation of payment and the date on which the Kit is received. The estimated delivery time is between 3 and 4 days for European countries and between 7 and 10 days for all other countries.

4.2 On the web pages of www.equinecode.com we inform of the indicative delivery time of each article, which should always be considered for all purposes as merely informative, exempting Sanbiotec Consulting, S.L. from any liability in the event that these are not fulfilled.

4.3 Under no circumstances shall any delay in the receipt of an order justify the cancellation of the order or any claim for compensation by the Customer or third parties.

4.4 The indicative deadlines indicated for the delivery of the Kit to the customer will always begin to count from the receipt by Sanbiotec Consulting, S.L. of the actual confirmation of payment of the total amounts, so that until that time will not begin to manage the order. If the receipt or acceptance is received after 18:00 hours, the order will be processed from the next day.

4.5 Orders placed on Fridays after 18:00 hours will be processed from Monday of the following week. Orders placed on weekends or public holidays will be processed on the first working day of the following week.

4.6 The delivery time described above shall be effective in the event that the customer cannot be reached at the place and time specified by him, in which case the item shall be deemed to have been delivered if he is not at the address on the date and at the place of delivery specified.

4.7 The Client will receive the result of the analysis of the sample within approximately 1 month, which will always begin to count from the reception by Sanbiotec Consulting, S.L. of the sample collected by the Client.

4.8 These deadlines are for guidance only and Sanbiotec Consulting, S.L. will endeavour to respect them as far as possible.

4.9 Any penalty clause for delays introduced by the Customer in his order shall become null and void upon acceptance of these General Terms and Conditions of Purchase.

4.10 Delivery shall be deemed to have taken place once the result has been made available to the Client, by e-mail and through private access to their account on the website www.equinecode.com.

5. WARRANTIES AND RESERVATIONS
5.1 Sanbiotec Consulting, S.L. represents and warrants that it is able to sell the services through its website www.equinecode.com and that it is in possession of sufficient means (both in terms of technical equipment and availability of services) for the complete sales process.

5.2 Sanbiotec Consulting, S.L. makes every effort to ensure that the information appearing on its web pages or documents is correct, but cannot guarantee the accuracy of the descriptions.

5.3 Sanbiotec Consulting, S.L. grants guarantees on the results that may be obtained from the analysis of the sample collected by the Client.

5.4 Sanbiotec Consulting, S.L. is not responsible if the result obtained from the collected sample is not as expected by the Client.

5.5 Sanbiotec Consulting, S.L. is not responsible for inaccurate results of the analysis if the sample is not taken according to the detailed instructions provided in the collection kit.

5.6 Sanbiotec Consulting, S.L. guarantees that the information transactions carried out through the forms on its order pages are totally secure within the current technological framework. In the purchase forms, all operations involving the transmission of personal data are carried out using a secure environment.

5.7 In addition to the reminder of the existence of a legal guarantee of conformity for the goods, the existence and conditions of after-sales services and commercial guarantees.

NOTE: To help us improve our service. The customer service department has an after-sales service to solve any problem with our articles or shipments, through which we try to offer you a fast and efficient service.

6. RETURNS, WITHDRAWAL AND CANCELLATION.
6.1 Right of withdrawal. The right of withdrawal is not applicable to this service, according to Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, in its Art.103. Exceptions to the right of withdrawal.

The right of withdrawal shall not apply to contracts relating to:

a) The provision of services, once the service has been fully performed, where performance has begun, with the prior express consent of the consumer and user and with his acknowledgement that he is aware that, once the contract has been fully performed by the trader, he will have lost his right of withdrawal.

6.2 In case of cancellation of the service, the Client must request it by sending an e-mail to info@equinecode.com or call us at +34 673000981, if the sample collection kit has not yet been sent, the service may be cancelled and the amount of the purchase will be refunded within a maximum of 14 days from the notice of cancellation of the order, in the same way in which the payment was made.

7. RESPONSIBILITIES

7.1 Sanbiotec Consulting, S.L. is not responsible for what is exclusively attributable to the Client.

7.2 Sanbiotec Consulting, S.L. cannot guarantee the continuous availability and delivery times of the services offered on its website. The Client agrees to assume within reasonable limits, delays in the availability of the service if these situations should arise.

7.3 Sanbiotec Consulting, S.L. shares the work of the process of sale and distribution of its services with other suppliers (transport...etc), so that if any problem or delay occurs in this process in no case shall Sanbiotec Consulting, S.L. be held responsible for it.

7.4 Therefore, with the acceptance of these Conditions of Purchase, the Client expressly waives any liability, contractual or extra-contractual, damages to Sanbiotec Consulting, S.L. for possible problems, delays in delivery or cancellations of purchases if the case should arise.

7.5 Sanbiotec Consulting, S.L. accepts no liability arising from the sale of its services, for failure to meet the expectations of the client or for any other damage to the Client or third parties.

7.6 The use that the Client makes of the results obtained is the sole responsibility of the Client, in such a way that Sanbiotec Consulting, S.L. shall not be liable in any way (either directly or indirectly) for any direct or indirect damage that the Client may cause to itself or to third parties as a result of such use.

7.7 The Client expressly exempts Sanbiotec Consulting, S.L. from any liability arising from the use of the results obtained in the analysis of the sample.

7.8 Under no circumstances shall Sanbiotec Consulting, S.L., managers, senior managers, administrators, shareholders, agents or employees of Sanbiotec Consulting, S.L. incur any liability for any direct or indirect cause related to the use made by the Client of the results obtained.

8. COMMUNICATIONS
8.1 The Client undertakes to keep the e-mail address and mobile phone number provided in the order always operational, active and updated for fluid communications with Sanbiotec Consulting, S.L., as it is the preferred means of communication of Sanbiotec Consulting, S.L. for the smooth and agile management of the sales management process.

8.2 If the Client wishes to change the e-mail address or contact mobile phone number provided when making the purchase, he/she must do so by e-mail communication, complying with the security requirements demanded by Sanbiotec Consulting, S.L. in order to verify the legitimacy of the request, so that at no time the communication between the two parties is interrupted.

8.3 The Customer shall bear all responsibility for the consequences that the lack of operability of his e-mail address or mobile phone number or the lack of communication to update this information in our records may produce.

8.4 In the event that the Client is assigned individual registration and authentication data for legitimate access to the websites of Sanbiotec Consulting, S.L. (such as user names, keys or passwords), the Client shall be solely responsible for their use, protection and maintenance of confidentiality. The use of these identifiers and the communication of the same to third parties, will occur under the sole responsibility of the Client, the latter being ultimately responsible for purchases, communications or actions carried out using such data.

9. LEGAL INFORMATION

9.1 The Customer under 14 years of age needs the consent of their parents, guardians or legal representatives to make a purchase on www.equinecode.com. The Client acknowledges that he/she is over 14 years of age or has the corresponding consent of his/her parents, guardians or legal representatives to make purchases and payments through the pages of Sanbiotec Consulting, S.L..

9.2 The Client shall indemnify Sanbiotec Consulting, S.L. for all costs that may arise in the event of being charged by the Client (or by third parties related to the Client as a result of the purchase), in any case for which the Client is not directly responsible, including in such compensation the fees and expenses of the lawyers of Sanbiotec Consulting, S.L., even when the court decision is not final.

9.3 In all matters not provided for in this document, as well as in the interpretation and resolution of conflicts that may arise between the parties as a result of this document, Spanish law shall apply.

9.4 If any dispute or difference arises between the Buyer and Seller in the interpretation and execution of this document, and is not resolved by mutual agreement, it shall be resolved at the request of either party and after written notice to the other, by arbitration.

9.5 The Customer has the possibility of resolving possible incidents arising from the purchase of an item via the link to the ODR platform (Online Dispute Resolution) https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=ES.

9.6 These General Terms and Conditions are governed by Spanish law.

The parties submit, for the resolution of any conflicts that may arise, to the courts and tribunals of the User's domicile, to the place of fulfilment of the obligation or to the place where the property is located if it is immovable.
